Quando isso acontece, at\u00e9 que haja o pagamento, v\u00e3o sendo gerados valores retroativos que precisam ser pagos. Foi o que aconteceu com as datas-bases de 2019 a 2021 e tamb\u00e9m com as progress\u00f5es de 2014 a 2023, que foram objeto de acordo e est\u00e3o sendo pagos de forma parcelada pelo Governo do Tocantins. Ocorre que, no c\u00e1lculo feito pelo Governo, n\u00e3o foram considerados os juros e nem a corre\u00e7\u00e3o monet\u00e1ria. Por isso, a AJUSP-TO est\u00e1 ingressando na Justi\u00e7a para garantir que o servidor receba o seu direito;<\/span><\/li><\/ul><p style=\"margin: 0cm; line-height: 115%; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-family: 'Arial',sans-serif; color: #191818;\">\u00a0<\/span><\/p><ul><li class=\"MsoNormal\" style=\"line-height: 115%;\"><b><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; background: yellow; mso-highlight: yellow; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">RETROATIVOS DOS 25% NO PER\u00cdDO DE 2008 A 2012:<\/span><\/b><span style=\"font-family: Arial, sans-serif; color: #242222; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"> Sobre o reajuste de 25%, cabe lembrar que, em 08 de fevereiro de 2023, a ADI 4013 transitou em julgado no Supremo Tribunal Federal (STF)<\/span><span style=\"font-family: Arial, sans-serif; color: #222222; padding: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; border: 1pt none windowtext;\">, e reconheceu como leg\u00edtimo o direito dos servidores p\u00fablicos do Quadro Geral e dos Profissionais da Sa\u00fade aos<\/span><b><span style=\"font-family: 'inherit', serif; color: #222222; padding: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; border: 1pt none windowtext;\">\u00a025%.<\/span><\/b><span style=\"font-family: Arial, sans-serif; color: #222222; padding: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; border: 1pt none windowtext;\">\u00a0Ocorre que, at\u00e9 o presente momento, o Governo do Tocantins n\u00e3o cumpriu a decis\u00e3o do STF e n\u00e3o implementou o direito aos 25% no contracheque do servidor p\u00fablico.<\/span><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\"> A A\u00e7\u00e3o Judicial mencionada aqui se refere somente aos RETROATIVOS de 2008 a 2012 e \u00e9 diferente da A\u00e7\u00e3o Coletiva de implanta\u00e7\u00e3o do Reajuste de 25%, ou seja, implanta\u00e7\u00e3o do direito no contracheque do servidor. <\/span><\/li><\/ul><p class=\"MsoNormal\" style=\"margin-bottom: 0cm; line-height: 115%;\"><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">\u00a0<\/span><\/p><ul><li class=\"MsoNormal\" style=\"line-height: 115%;\"><b><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; background: yellow; mso-highlight: yellow; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">DIFEREN\u00c7A DE 1,15% DA DATA-BASE 2025:<\/span><\/b><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\"> A\u00e7\u00e3o Coletiva com Pedido de Repara\u00e7\u00e3o de Perda Salarial Real (1,15%), referente \u00e0 Data-base 2025, dos servidores p\u00fablicos do Poder Executivo Estadual. Em 13 de maio de 2025, o Estado do Tocantins editou a Lei n\u00ba 4.671, concedendo a revis\u00e3o geral anual (data-base) com percentual de 4,17%. Ocorre que o INPC apurado no per\u00edodo entre outubro de 2024 e abril de 2025 gerou um percentual de 5,32%, conforme dados oficiais do IBGE. O que a AJUSP-TO verificou \u00e9 que o Governo do Tocantins utilizou, na hora de fechar o \u00edndice da Data-base 2025, o m\u00eas de refer\u00eancia de Janeiro de 2025, quando devia ter utilizado o de Abril de 2025. Esse pagamento parcial gera uma perda real de 1,15% nos vencimentos dos servidores.<\/span><\/li><\/ul><p class=\"MsoNormal\" style=\"margin-bottom: 0cm; line-height: 115%;\"><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">\u00a0<\/span><\/p><p class=\"MsoNormal\" style=\"margin-bottom: 0cm; line-height: 115%;\"><b><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">DOCUMENTA\u00c7\u00c3O<\/span><\/b><\/p><p class=\"MsoNormal\" style=\"margin-bottom: 0cm; line-height: 115%;\"><span style=\"font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #191818; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">Cada a\u00e7\u00e3o judicial, exige uma documenta\u00e7\u00e3o espec\u00edfica que o associado precisa organizar e enviar assinada para a AJUSP-TO.
